Palo Alto administrators in California have granted an exemption to a restaurant owned by a celebrity chef from the city’s ban on gas stoves.

According to Palo Alto Online, the newly planned restaurant of Jose Andres, Zaytinya is the latest Simon Property Group building that has received project approval for 2019. This includes a gas pipeline, on which the restaurant depends. Planning staff told the company the plan changed after the City Council revised the building code.

Simon sent a letter to the city council in April, threatening it with a lawsuit should they continue the ban.

According to a city council statement, this “is a one-off situation where parts of the projects were under construction or built when the City’s new construction rule all-electric went into effect.” Palo Alto is implementing its all-electric rule for new construction and major remodels, except for this unique situation.

Anna Shimko, attorney at SPG Group, LLC, wrote that SPG was confident in its ability to use gas appliances within Building EE, despite the Reach Code’s legal defects and unconstitutional nature. SPG is prepared to take any action necessary to enforce this right. Zaytinya’s signature flavors are achieved by using traditional cooking methods, which only natural gas appliances can provide.

Department of Energy released a new rule early in February. The new rule would create an energy conservation standard for electric and gas appliances. Richard Trumka Jr. , a top Consumer Product Safety Commission Official, told Bloomberg before the February rule that banning gas stoves was “on the table,” citing an study claiming a link between cooking appliances and childhood asthma.

Zaytinya won’t be able to compromise its reputation and the quality of its food if SPG is unable to provide gas for Building EE. Zaytinya may decide not locate in the City. Shimko stated that this would be a loss to the residents of Palo Alto and a compensation for which SPG will be required to seek redress.
